Mississippi Legislature Changes Policy on Medicare Phone Marketing

Mississippi Legislature recently passed House Bill 1350 to change the Telephone Solicitation Act and the Insurance Code. Agents in MS are not longer permitted to initiate phone calls for the sale of Medicare Supplement.

The changes are outlined below:

First, as it relates to cold call prospecting, agents cannot initiate a telephone conversation for the sole purpose of soliciting the purchase of a Medicare Supplement policy. However, agents can initiate a call to solicit a different product (e.g., dental) and then pivot to Medicare Supplement after discussing the other product. 

Second, if a customer reaches out to discuss Medicare Supplement in response to a lead, television ad, direct mail etc., agents may call and immediately discuss Medicare Supplement.
